Terms & Conditions

These Sales Agreement Terms govern all quotations, orders, and sales made by Elevate Appliance Studio Austin, LLC ("Elevate Appliance Studio," "we," "us") and your use of this website. By placing an order with Elevate Appliance Studio, you agree to these Terms.

Pricing & Payment

• Pricing is valid for 30 days and subject to manufacturer changes.
• A deposit is required to initiate orders. Deposits are refundable until the manufacturer ships the product; thereafter, they are non-refundable.
• Final payment is due prior to authorizing release of product from the manufacturer.
• Credit card payments incur a non-refundable 3% fee; ACH or wire transfers have no fee.
• All prices are in U.S. dollars. Charges will appear on your statement under the name Elevate Appliance Studio.

Returns & Special Orders

• Products removed from factory packaging are non-returnable.
• Unopened returns are subject to a 30% restocking fee.
• Special and made-to-order items are final sale.

Storage & Ownership

• We provide 30 days of complimentary storage. Extended storage may incur monthly fees.
• Elevate Appliance Studio retains ownership and risk of loss while product remains in its warehouse. Ownership and risk transfer to the purchaser upon pickup or delivery.

Installation Services

• Installation is performed by an independent, licensed, and insured contractor. The installer is solely responsible for installation performance. We coordinate installation but are not the contractor of record.
• Installation is limited to standard placement per manufacturer specifications.
• The purchaser is responsible for ensuring site readiness, including proper electrical, gas, and water connections and clearances per manufacturer specifications.
• If installation cannot be completed due to site conditions, project inaccuracies, lack of readiness, or other circumstances attributable to the purchaser or contractor, a retrip fee of $95 per visit will apply within the Austin service area.

Lead Times

Stated lead times are estimates and subject to manufacturer schedules. We are not responsible for delays beyond our control.

Warranties

Products are covered solely by manufacturer warranties. We do not provide independent warranties.

Force Majeure

We are not liable for delays beyond our control, including manufacturer delays, supply chain disruptions, or acts of God.

Limitation of Liability

Except for direct property damage resulting from proven negligence, our liability is limited to the amount paid for the product or service. We are not liable for indirect, consequential, or economic damages, including project delays or lost profits. The purchaser releases Elevate Appliance Studio from claims arising from inaccurate project information, inadequate site preparation, or structural issues not caused by our negligence.

Confidentiality & Accuracy

All proposals, specifications, and pricing provided are proprietary to Elevate Appliance Studio and intended solely for the recipient. The purchaser affirms that all project specifications provided are accurate and complete.

Governing Law

This Agreement is governed by Texas law. Disputes shall be resolved in Travis County, Texas.
